

Employer Nomination Visa (SubClass 186)
Permanent Residence under Employer Nomination Scheme (ENS): This visa allows Australian employers to fill highly skilled positions with foreign workers on a permanent basis, if the employer cannot fill the position from the Australian labour market or through the company’s training programs. The Employer Nomination Scheme (Sub Class 186) allows eligible Australian employers to sponsor suitably skilled overseas workers to live and work permanently in Australia. The Employer Nomination Scheme (Sub Class 186) is a Permanent Residency visa. Once granted, it allows the holder and any family members included in the application to stay in Australia indefinitely.
The five year travel restriction only prevents re-entry into Australia after the expiry of the five year period, after which time in order to re-enter Australia, a Resident Return visa or other suitable visa will need to be obtained. It does not affect holders of this visa who are inside Australia (who are allowed to remain indefinitely

Step 2: Visa application by the nominated individual:
- To apply for this visa, the visa applicant must:
- Be nominated by an approved employer
- Be younger than 45 or 50 years of age depending on which stream the application is made under (unless a narrow exception applies).
- Meet the skills and qualifications requirements (unless an exception applies)
- The position in the employer’s business must:
- Be full-time and available for at least 2 years;
- Be in accordance with the standards for working conditions provided under Australian industrial laws;
- Correspond to an occupation on the ENS List of Occupations;
- Attract a base salary that is at least the Market rate. Market salary rate involves terms and conditions of employment that are at least the same as those that would apply to an Australian employed in the same workplace and occupation. Threshold salary is $53,900 + Super
